Terms and Conditions
Acceptance of terms
By creating an account, browsing, buying, selling, ordering food, arranging delivery or using any Trada service, you agree to these Terms and the policies shown during the relevant transaction.
Eligibility and accounts
You must provide accurate information, have legal capacity to use the service and keep your credentials secure. You are responsible for activity performed through your account and must report suspected unauthorized use promptly.
Marketplace role
Trada provides technology that connects buyers, sellers, restaurants, delivery providers and payment services. The identified seller remains responsible for its listings, stock, product quality, lawful sale, warranties and fulfilment obligations.
Listings and pricing
Sellers must publish accurate titles, descriptions, images, condition, availability, prices, taxes, delivery expectations and return information. Trada may correct, hide or remove misleading, prohibited, unsafe or unavailable listings.
Orders
An order is created when the platform confirms its reference. Acceptance may depend on stock, seller confirmation, payment and delivery availability. Users must review quantities, variants, address, price and payment method before submission.
Payments
Available methods are shown at checkout. You authorize the selected provider to process the displayed amount. Pending, failed, reversed or duplicated transactions are handled using provider records and Trada transaction references.
Escrow and release
Where escrow applies, funds may be held until agreed conditions are met. Buyers and sellers must respond to confirmation and dispute requests honestly and within displayed time limits. Trada may release, return or retain funds as permitted by the applicable transaction terms.
Delivery and collection
Delivery times are estimates unless expressly guaranteed. Users must provide an accessible and accurate location, remain reachable and inspect orders where appropriate. Extra costs caused by an incorrect address or failed collection may be charged where disclosed.
Food orders
Restaurants control menus, preparation, ingredients, allergens and availability. Customers must communicate dietary or allergy concerns directly and review restaurant information. Food cancellation and refund eligibility may change once preparation begins.
Cancellations, returns and refunds
Eligibility depends on order status, product condition, category, seller policy and applicable law. Users must submit truthful reasons and evidence within the allowed period. Approved refunds are returned through an available method and processing time may vary by provider.
Reviews and content
Reviews must reflect a real experience and must not contain threats, harassment, private information, illegal content or manipulation. You grant Trada permission to display and moderate content submitted to the platform.
Prohibited conduct
Users must not commit fraud, impersonate others, evade fees, manipulate reviews, sell prohibited goods, misuse personal data, attack the platform, interfere with another user, create deceptive listings or use Trada for unlawful activity.
Seller duties
Sellers must maintain legal registrations where required, accurate inventory, fair fulfilment, customer communication, compliant receipts, product safety and appropriate after-sales support. Seller access may be restricted when service or compliance standards are not met.
Suspension and termination
Trada may restrict, suspend or terminate access to protect users, investigate risk, comply with law or respond to material or repeated violations. Where appropriate, users will receive information about the action and available review process.
Service availability
We work to keep services available but do not guarantee uninterrupted access. Maintenance, provider outages, connectivity, emergencies or events beyond reasonable control may affect availability.
Liability
To the extent permitted by law, Trada is not liable for indirect or consequential loss. Nothing in these Terms excludes rights or liability that cannot legally be excluded. Any platform liability is assessed against the affected transaction and applicable law.
Indemnity
You are responsible for losses or claims resulting from your unlawful conduct, violation of these Terms, infringement of another person’s rights or misuse of the platform.
Governing law and disputes
These Terms are governed by applicable laws of Tanzania. Users should first contact Trada Support with the relevant reference and evidence so the issue can be reviewed before other remedies are pursued.
Changes
We may update these Terms as services and legal requirements change. Continued use after the effective date means the updated Terms apply, subject to any notice or consent required by law.
Contact
Questions about these Terms may be submitted through the Trada contact or support page.
Definitions and interpretation
“Buyer” means a user acquiring or seeking products, food or services. “Seller” includes merchants, restaurants and other approved suppliers. “Order” means the electronic record generated by Trada for a proposed transaction. “Payment Provider” means the bank, mobile-money operator, card processor or other provider that processes funds. “Escrow” means an arrangement under which funds are held pending stated release conditions. “Content” includes listings, messages, reviews, images, documents and other material supplied through Trada. Headings assist reading and do not limit a clause.
Formation of a transaction
A listing is an invitation to transact and is not automatically a binding offer by Trada. The buyer submits an order based on the displayed product, quantity, variation, price, delivery and payment information. A transaction may remain subject to seller acceptance, stock confirmation, verification, payment authorization, delivery coverage or other disclosed conditions. The electronic order record, accepted changes and applicable checkout notices form part of the transaction. A seller must not substitute a materially different item without the buyer’s informed agreement.
Fees, taxes and currency conversion
Prices and charges are displayed before confirmation where reasonably possible. The buyer or seller is responsible for taxes, duties, levies, mobile-network charges, banking fees or currency-conversion costs allocated to that party by law or the transaction screen. Trada may charge platform, escrow, delivery, withdrawal, promotional or other service fees where disclosed. Estimated fees may change if the user changes the order, address, delivery method or payment channel. Except where law requires otherwise, a third-party provider’s exchange rate and processing fee are controlled by that provider.
Escrow funding, custody and release instructions
Escrow availability, permitted transaction types, funding methods, release events and fees are shown in the relevant flow. Funds recorded as pending are not treated as finally received until confirmed by the relevant provider. Neither party may submit false completion evidence, pressure another party to release funds prematurely or attempt to bypass an active dispute. Trada may pause release while reviewing fraud, sanctions, chargeback, ownership, delivery or legal concerns. Release to a seller, refund to a buyer or another permitted disposition will follow the agreed transaction terms, verified events, dispute outcome and applicable law.
Money transfer, payouts and withdrawals
Seller payouts and other transfers may require identity and account verification, minimum or maximum limits, processing fees, security holds and provider availability. The recipient must ensure that bank or mobile-money details belong to the authorized beneficiary. Trada may reject, delay, reverse or request evidence for a transfer affected by incorrect details, duplicate instructions, suspected fraud, provider error, legal restraint or compliance review. Processing estimates do not guarantee the receiving institution’s posting time.
Disputes, evidence and platform decisions
A user opening a dispute must provide an accurate description, transaction reference and reasonably available evidence within the displayed period. Relevant evidence may include listing information, messages, photographs, delivery events, inspection records, payment confirmations and return tracking. Trada may request more information, facilitate settlement or issue a platform decision under the applicable policy. Failure to cooperate may affect the outcome. Platform review does not remove any non-waivable right or lawful remedy available to a party.
Product safety, prohibited items and recalls
Sellers must ensure products are lawful, authentic, reasonably safe and compliant with applicable labeling, licensing, standards and recall duties. Prohibited, counterfeit, stolen, dangerous, misleading or restricted items must not be listed. Trada may remove a listing, notify affected users, preserve evidence, stop transactions or cooperate with authorities when a safety or legality concern arises. Buyers should follow product instructions and promptly report suspected hazards.
Intellectual property notices
A rights owner or authorized representative may report suspected infringement with identification of the protected work or right, the affected listing, contact information and a good-faith statement. Sellers must respond truthfully and provide authorization or provenance where requested. Trada may remove content, restrict repeat infringers and preserve relevant records. False or abusive notices may result in account action and responsibility under applicable law.
Communications and electronic records
Users consent to receive transaction, payment, security, delivery, dispute and support communications electronically through the app, website, email, SMS, push notification or another selected channel. Electronic records, confirmations, timestamps and authenticated actions may be used as evidence of platform activity, subject to applicable law. Users must keep contact information current and should retain important transaction references and receipts.
Confidentiality and platform data
Non-public transaction, customer, seller, operational and security information obtained through Trada must be used only for the permitted service or transaction. Users must not scrape the platform, compile user directories, disclose private messages, sell platform data or use another party’s details for unsolicited marketing. Trada may apply technical restrictions and pursue available remedies to protect users and platform integrity.
Force majeure and third-party infrastructure
Trada is not responsible for delay or failure caused by events beyond reasonable control, including natural disaster, epidemic, civil disruption, government action, telecommunications failure, power outage, cyber incident, payment-network interruption, transport disruption or supplier failure. We will take reasonable steps to restore affected services and communicate material impacts. Obligations already accrued, including lawful payment or refund duties, remain subject to the circumstances and applicable law.
Notices, severability and entire agreement
Formal notices may be delivered through account notifications, the registered email or phone, or publication where broadly applicable. If a clause is unenforceable, it will be limited to the minimum extent required and the remaining clauses continue. Failure to enforce a provision is not a waiver. These Terms, the transaction record and incorporated policies constitute the agreement for the relevant Trada service and replace inconsistent prior discussions about that service.
